I GENERAL CONDITIONS
The present general conditions outline the rights and obligations of the parties concerned within the framework of sales made via the Atelier Benneton SAS website, https://www.bennetongraveur.com.

Atelier Benneton SAS (hereinafter referred to as the Seller) and the buyer (hereinafter referred to as the Customer).
The purchasing of products presented for sale at https://www.bennetongraveur.com is subject to the present General Conditions of Sale for the website https://www.bennetongraveur.com (hereinafter referred to as the Site).
It is specified that purchases may only be made through the Site by natural persons who are not traders and who are over 18 years of age and have full legal capacity.
Products can be purchased for delivery within France or worldwide. These conditions do not, therefore, apply to purchases made at our store located at 75 Boulevard Malesherbes, 75008 Paris or to purchases made over the phone or by any other means.
Confirmation of the buyer’s (the Customer’s) order implies full acceptance of the present General Conditions of Sale, which will prevail over all earlier versions and with which the customer acknowledges that they are familiar prior to placing the order. They also provide the Customer with information regarding the conditions that apply and the steps to take in order to place and track their order.
Benneton Graveur SAS reserves the right to modify the present General Conditions of Sale at any time, and only those conditions in force on the website on the date on which the order is placed will apply.
II PRODUCTS & PRICING
II-1 Products
Only Products featured on the Site on the day on which the Customer visits it are available to purchase. To this end, the Customer will be informed of the availability of the Product they wish to purchase at the time of placing their order.
The product images shown are as accurate a reproduction of the product in question as possible, but are not contractually binding. The Customer is encouraged to read the respective Product description for information on its basic characteristics.
We do our utmost to ensure that the colours of the items shown are as true to life as possible. That said, as the colour of the items displayed on the screen may vary according to your screen settings, we cannot guarantee that the colour you see is perfectly accurate.
II-2 Pricing
Prices are stated in euros, exclusive of any applicable taxes and delivery charges. The Value Added Tax rate in force in mainland France on the day on which the order is placed will apply. The product prices stated on the Site at the time at which the order is placed will apply. The seller reserves the right to modify its prices at any time prior to accepting the order.
The fixed-rate order handling and delivery charge will be stated on the order summary page displayed prior to the Customer confirming their order.
III PURCHASES
III-1 Order placement
Customers can order products from the Benneton Graveur SAS store located at 75 Boulevard Malesherbes, 75008 Paris, directly online, from both within France and abroad, via the Site, https://www.bennetongraveur.com.
The Customer will require certain IT and telecommunications tools (computer, Internet connection and valid e-mail address) in order to place an order.
III-2 Ordering process
The Customer must follow the various steps stated on the Site. All orders placed will be confirmed by Benneton Graveur via a confirmation e-mail.
An order can be placed for one or more delivery addresses in France or worldwide.
All new Customers must complete the fields they are asked to complete in order to create their profile, which can be accessed in the ‘My account’ section.
The Customer must complete the form provided honestly and accurately, providing the information required to identify them, notably including a valid e-mail address and a (personal and confidential) password of their choice that will be required to log in to the Site in the future.
Any Customer who has already created a Customer Account must log in using their e-mail address and password after clicking on ‘Continue your order’.
The Customer acknowledges that simply entering these login details will be considered proof of their identity.
Fields marked with an asterisk are compulsory and are required for the purposes of processing and delivering the order. This information is strictly confidential.
Any Customer wishing to place an order must select the Product(s) of their choice by clicking on ‘Add to my basket’.
The Customer may do the following at any time during the process:
– check the number of Products in their basket and view detailed information about each by clicking on ‘My basket’,
– continue to select Products to order by clicking on ‘Continue shopping’,
– view the Products they have selected by clicking on ‘My selection’,
– complete their order by clicking on ‘Complete my order’.
Approval of the order summary indicates the Customer’s consent. This consent is equivalent to a handwritten signature and is proof of the contract that the Parties have entered into, the completeness of the order and the payment of all amounts due in the framework of said order.
The purchase order will be recorded in Benneton Graveur SAS’s records, which are stored in a reliable and lasting format. The Customer acknowledges that the purchase order should be considered proof of the contractual relationship that now exists between the Parties.
The Customer will be able to print the order summary submitted along with the acknowledgement of receipt. The order summary can also be viewed in ‘My account’.
In the case of personalised stationery, the Seller wishes to remind you that the mock-up displayed at the end of the ordering process is in no way contractually binding. Benneton Graveur strives to provide an accurate representation of the end-product, but since the pieces are handmade, differences may, nevertheless, occur.
III-3 Availability
Our products and prices are valid for as long as they are displayed on the site and subject to availability. This being the case, you will be informed of the availability of the product(s) you wish to order at the time of placing your order. Errors or changes may occasionally be made, particularly in the event that we simultaneously receive orders for the same product from several customers.
In the event that a product is found to be unavailable after you have placed your order, we will inform you that this is the case by e-mail or by phone as soon as possible.
Lead times may vary according to the production methods involved, especially where personalised items are concerned, and we will inform you by e-mail or by phone as soon as possible.
Should you choose to cancel your order, you will be refunded within 30 days of payment if your bank account has already been debited.
Benneton Graveur SAS cannot be held responsible in the event of any product(s) being out of stock or otherwise unavailable and reserves the right to change the items presented for sale on the Site at any time and without notice.
IV PAYMENT
IV-1 General points
The Seller reserves the right not to confirm the order in the following cases:
– In the event of an existing dispute(s) with the Customer,
– In the event of any total or partial non-payment of a previous order by the Customer,
– In the event of a refusal by a banking organisation to authorise a bank card payment.
Benneton Graveur SAS reserves the right to modify its selling prices at any time prior to an order being placed. Products and services will be charged on the basis of the rates in force at the time the order is registered.
These prices are applicable on the Site. Under no circumstances can the same prices be requested in-store (or vice-versa).
IV-2 Billing
An invoice, which may, if necessary, serve as a guarantee, will be issued for each order that is confirmed and paid for, and sent to the customer by e-mail.
IV-3 Payment
Full payment will be taken securely and in euros, by credit card or PayPal, at the time of placing the order.
At no point will Benneton Graveur be aware of the information entered by the customer on the PayPal secure payment platform.
Payment can be made on the Site using a Visa, Mastercard or American Express card.
V DELIVERY
V-1 Delivery terms
In the event that the respective availability dates of any of the Products in an order should differ, the order will be delivered in its entirety on the latest availability date.
Delivery will be made via La Poste (Colissimo) or FedEx, at the Customer’s request, in which case they will be required to provide us with their FedEx account number or otherwise be billed at the current FedEx rate.
The Customer has a period of 48 hours after receipt of their order to return to us any goods found to be faulty or to have been damaged during transport, provided that they have notified us in writing on the carrier’s acceptance slip of the damage observed, or, failing this, that they have stated ‘subject to unpacking’ on the slip in question.
V-2 Delivery charges, customs and taxes
Delivery charges (mainland France, French overseas departments and territories or international) will be calculated according to weight at the time the order is confirmed.
Customs and import taxes are not included in the delivery charges stated and are to be paid by the customer (they may be requested upon delivery in certain countries outside the European Union).
VI WITHDRAWAL
In accordance with the provisions of Art. L 121-20 of the Consumer Code, the buyer has a period of 7 clear days in which to exercise their right of withdrawal without having to justify their reasons or pay any penalties.
During this period, which begins at the point of delivery, the buyer may cancel all or part of their order and return the product(s) in question at their own expense. This option does not apply to goods made to the Customer’s specifications or that have been clearly personalised or that, due to their nature, cannot be returned or are likely to deteriorate rapidly.
VII LIABILITY
The liability of Benneton Graveur SAS for the products delivered will be limited to the price of the faulty or non-compliant product(s), subject to the applicable commercial and legal guarantees and any other remedies permitted by law.
In the event of a dispute, only the French version of the present general conditions of sale will be legally valid, and the Commercial Court of Paris will have sole jurisdiction.
II PRODUITS-PRIX
II-1 Produits
Seuls les Produits figurant sur le Site au jour de sa consultation par le Client sont proposés à la vente. A cette fin, le Client est informé lors de la passation de sa commande de la disponibilité du Produit qu’il souhaite sélectionner.
Les photographies illustrant les produits présentés en sont une reproduction la plus exacte possible, mais n’ont pas valeur contractuelle. Le Client est invité à consulter le descriptif de chaque Produit pour en connaître les caractéristiques essentielles.
Nous faisons notre possible pour que les couleurs des articles soient le plus proche possible de la réalité. La couleur des articles à l’écran peut varier en fonction des réglages de votre écran, nous ne pouvons garantir une fidélité parfaite.
II-2 Prix
Les prix sont indiqués en Euros Toutes Taxes Comprises (TTC), hors frais de livraison. La Taxe sur la Valeur Ajoutée est celle en vigueur sur le territoire français métropolitain au jour de la commande. Les prix appliqués sont ceux figurant sur le Site au moment de la commande. Le vendeur se réserve le droit de modifier ses prix à tout moment avant la prise de la commande.
Le montant forfaitaire de participation aux frais de préparation et de livraison est communiqué au Client sur le bon récapitulatif de la commande, avant validation de cette dernière.
III ACHATS
III-1 Modalités de Commande
Le Site https://www.bennetongraveur.com permet de commander à Benneton Graveur SAS des produits de notre magasin situé 75 boulevard Malesherbes, 75008 Paris directement en ligne via l’Internet depuis la France et l’étranger.
Pour passer commande, le Client doit être équipé d’outils informatiques et de télécommunication (ordinateur, connexion internet, adresse de courrier électronique valide).
III-2 Processus de commande
Le Client doit suivre les différentes étapes spécifiées par le Site. Toute commande passée sera confirmée par l’envoi d’un courriel de confirmation par Benneton Graveur.
Une commande peut être effectuée pour une ou plusieurs adresses de livraison en France et dans le monde.
Tout nouveau Client doit renseigner les champs qui lui sont proposés pour créer son profil qui sera accessible dans la rubrique « Mon Compte ».
Le Client doit remplir avec exactitude le formulaire mis à sa disposition, sur lequel il doit mentionner les informations nécessaires à son identification, dont notamment une adresse électronique valide et un mot de passe de son choix (qui lui sera personnel et confidentiel) qui lui serviront ultérieurement pour s’identifier sur le Site.
Tout Client déjà titulaire d’un Compte Client doit s’identifier après avoir cliqué sur « Poursuivre votre commande», en saisissant son adresse électronique et son mot de passe.
Le Client accepte que la saisie de ces deux identifiants vaille preuve de son identité.
Les informations à fournir, marquées d’un astérisque sont obligatoires. Celles – ci sont nécessaires au traitement et à la livraison de la commande. Elles sont strictement confidentielles.
Le Client qui souhaite passer commande sélectionne le ou les différents Produits de son choix en cliquant sur « Ajouter à mon panier ».
A tout moment le Client peut :
– vérifier le nombre de Produits contenus dans son panier et obtenir une information détaillée sur chacun d’entre eux en cliquant sur « Mon panier »,
– poursuivre sa sélection de Produits en cliquant sur « Continuer ma visite »,
– consulter sa sélection de Produits en cliquant sur « Ma sélection »,
– terminer sa commande en cliquant sur « Finaliser ma commande ».
La validation du bon de commande récapitulatif constitue le consentement du Client. Ce consentement équivaut à une signature manuscrite et vaut preuve de la conclusion d’un contrat entre les Parties, de l’intégralité de la commande et de l’exigibilité des sommes dues en exécution de ladite commande.
Le bon de commande est enregistré sur les registres de Benneton Graveur SAS, eux-mêmes conservés sur un support fiable et durable. Le Client accepte que le bon de commande soit considéré comme une preuve des relations contractuelles intervenues entre les Parties.
Le Client aura la possibilité d’imprimer le bon de commande récapitulatif transmis avec l’accusé de réception. Le récapitulatif de la commande sera également accessible dans « Mon Compte ».
Dans le cas de la papeterie personnalisée le Vendeur tient à rappeler que la maquette présentée en fin de commande n’est en aucun cas contractuelle. Benneton Graveur s’efforce de rendre un aperçu proche du résultat final, le travail est artisanal et par conséquent des différences peuvent apparaître.
III-3 Disponibilité
Nos offres de produits et prix sont valables tant qu’ils sont visibles sur le site, dans la limite des stocks disponibles. Dans ce cadre, des indications sur la disponibilité des produits vous sont fournies au moment de la passation de votre commande. Des erreurs ou modifications peuvent exceptionnellement exister, notamment dans le cas de commandes simultanées d’un même produit par plusieurs clients.
Dans l’éventualité d’une indisponibilité de produit après passation de votre commande, nous vous en informerons par courrier électronique ou par téléphone dans les meilleurs délais.
Les délais de fabrication peuvent varier en fonction des modes de fabrication, notamment en cas d’une personnalisation, nous vous en informerons par courrier électronique ou par téléphone dans les meilleurs délais.
Si vous choisissez d’annuler votre commande, vous serez remboursés au plus tard dans les 30 jours du paiement si votre compte bancaire a été débité.
Benneton Graveur SAS n’encourt aucune responsabilité en cas de rupture de stock ou d’indisponibilité des produits et se réserve le droit de changer à tout moment et sans préavis les articles proposés dans le Site.
IV PAIEMENT
IV-1 Généralités
Le Vendeur se réserve le droit de ne pas valider la commande en cas de :
– Litige(s) existant(s) avec le Client,
– Non-paiement total ou partiel d’une commande précédente du Client,
– Refus d’autorisation de paiement par carte bancaire des organismes bancaires.
Benneton Graveur SAS se réserve le droit de modifier ses prix de vente à tout moment, avant la prise de commande. En effet, les produits et services sont facturés sur la base des tarifs en vigueur au moment de l’enregistrement de la commande.
Ces prix sont applicables dans le cadre du Site. Ils ne peuvent en aucun cas, faire l’objet d’une demande d’application en notre magasin (et vice versa).
IV-2 Facturation
Une facture, servant le cas échéant de garantie, est émise pour chaque commande confirmée et payée, puis transmise au client par email.
IV-3 Paiement
Le paiement sécurisé est effectué en euro, en totalité à la commande, exclusivement par carte bancaire ou via le système Paypal.
A aucun moment, Benneton Graveur n’a connaissance des informations saisies par le client sur le module de paiement sécurisé Paypal.
Les cartes bancaires acceptées sur le Site sont les suivantes : Visa, Master Card et American Express.
V LIVRAISON
V-1 Modalités de livraison
Dans les cas où les dates de disponibilité respective des Produits d’une commande seraient différentes, la livraison dans sa totalité interviendra à la date de disponibilité la plus éloignée.
La livraison est effectuée par La Poste (Colissimo) ou par FedEx si le Client en exprime la demande. Il nous fournira alors son numéro de compte FedEx ou à défaut sera facturé au tarif FedEx en vigueur.
Le Client dispose d’un délai de 48h après réception de sa commande pour nous renvoyer une marchandise défectueuse ou endommagée durant le transport, à condition d’avoir signalé par écrit sur le bon de réception du transporteur les dommages constatés, ou à défaut d’avoir apposé la mention “sous réserve de déballage”.
V-2 Frais de livraison, douanes et taxes
Les frais de livraison (France Métropolitaine, DOM – TOM et international) sont calculés en fonction du poids au moment de la confirmation de la commande.
Les taxes de douanes ou d’importations ne sont pas comprises dans les frais de livraison indiqués et sont à la charge du client (elles peuvent être demandées à la livraison dans certains pays hors Union Européenne).
VI RETRACTATION
Conformément aux dispositions de l’article L 121-20 du Code de la consommation, l’acheteur, dispose d’un délai de 7 jours francs, sans avoir à justifier de motifs ni à payer de pénalités, pour exercer son droit de rétractation.
Ce délai à compter de la livraison du produit lui permet d’annuler tout ou partie de sa commande et de retourner le produit à ses frais. Cette possibilité ne s’applique pas aux biens confectionnés selon les spécifications du Client ou nettement personnalisés ou qui du fait de leur nature ne peuvent être réexpédiés ou sont susceptibles de se détériorer rapidement.
VII RESPONSABILITÉ
La responsabilité de Benneton Graveur SAS au titre des produits livrés, est limitée au prix des produits défectueux ou non-conformes sous réserve des garanties commerciales ou légales applicables et de tous autres recours permis par la loi.
En cas de litige, seule la version française de ces conditions générales de vente ont une valeur légale, et seul le Tribunal de Commerce de Paris a autorité.
